2. Eligibility and accounts

• You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Services or place an order.
• You are responsible for the accuracy of information you provide and for activity under your account or email address.
• We may refuse service, close accounts, cancel orders, or restrict access at our sole discretion, including for suspected fraud, abuse, chargebacks, or violation of these Terms.

3. Products, pricing, and availability

• Product descriptions, images, sizes, inventory, and prices on the website are provided for convenience and may change without notice.
• We may correct pricing or availability errors, limit quantities, refuse or cancel orders, and refund amounts charged for cancelled orders.
• Living products (including sod) and bulk materials are perishable / variable by nature. Color, texture, moisture, and appearance may vary. We do not guarantee exact matches to photos or prior purchases.
• Quotes, estimates, and delivery fees shown online are estimates until your order is accepted and paid. Final charges are calculated on our servers at checkout.

4. Orders and payment

• An order is an offer to purchase. Submission of an order does not guarantee acceptance. We may accept, reject, or cancel any order in whole or in part.
• Payment is processed by our payment provider. By submitting payment information, you represent that you are authorized to use the payment method and authorize us (and our processor) to charge the full amount due, including tax, delivery, and processing fees.
• You agree not to initiate improper chargebacks. You must contact us promptly to resolve billing disputes before disputing a charge with your card issuer, except where prohibited by law.
• Fraudulent, false, or incomplete orders may be cancelled without liability to you beyond any required refund of unshipped amounts.

5. Pickup and delivery

• You are responsible for providing accurate contact and delivery information and for being available at the scheduled time.
• For delivery, someone must be on site to accept and sign as required. If no one is available, we may attempt redelivery, leave materials if safe and permitted, return the load, and/or charge additional fees.
• Delivery windows are estimates, not guarantees. Weather, traffic, equipment, inventory, and other factors may delay or reschedule service.
• Access, site conditions, dump location, and unloading instructions are your responsibility. We may refuse unsafe or inaccessible deliveries.
• Risk of loss for delivered goods passes to you upon delivery to the address or location you designate (or upon pickup if you choose pickup), except as required by law.

6. Inspection, returns, and claims

• Inspect all products at pickup or delivery. Notify us of shortages, damage, or obvious defects before the driver leaves or as soon as reasonably possible.
• Because sod and many landscaping materials are perishable, custom-cut, or bulk, all sales are final except where we agree in writing or where non-waivable law requires otherwise.
• Any approved return, replacement, or credit is limited to the purchase price of the affected goods (excluding delivery and processing fees unless we caused the error), and is our sole obligation for product issues to the maximum extent permitted by law.

7. Prohibited uses

You agree not to:

• Use the Services for unlawful, fraudulent, or abusive purposes
• Interfere with security, availability, or integrity of the Services
• Scrape, reverse engineer, or misuse catalog, pricing, or account data
• Impersonate others or provide false information
• Attempt unauthorized access to accounts, systems, or data

8. Intellectual property

The Services, including text, branding, logos, layout, software, and catalog presentation, are owned by Yard Stop or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or exploit them without our prior written consent, except for personal, non-commercial use of the storefront as intended.

9. Disclaimers

To the maximum extent permitted by law, the Services and all products are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that products will meet your specific landscaping, installation, or survival expectations after delivery or pickup.

10. Limitation of liability

To the maximum extent permitted by law, Yard Stop and its officers, directors, employees, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or related to the Services or any order, even if advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Services or an order will not exceed the amount you paid to Yard Stop for the specific order giving rise to the claim.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Yard Stop and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your orders, your delivery site conditions or instructions, your violation of these Terms, or your violation of any law or third-party right.

12. Force majeure

We are not liable for delay or failure to perform due to events beyond our reasonable control, including weather, natural disasters, labor disputes, supply shortages, transportation failures, utility outages, cyber incidents, government actions, or emergencies.

13. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Exclusive venue for any dispute arising out of or relating to these Terms or the Services shall be the state or federal courts located in Lake County, Florida (or the applicable federal district covering Lake County), and you consent to personal jurisdiction there. You waive any right to a jury trial to the extent permitted by law. Any claim must be brought individually and not as a class, consolidated, or representative action, to the extent permitted by law.

14. Changes

We may update these Terms at any time by posting a revised version on the website. The “Last updated” date will change when we do. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

15. Miscellaneous

• If any provision is held unenforceable, the remaining provisions remain in full force.
• Our failure to enforce a provision is not a waiver of our right to enforce it later.
• These Terms, together with the Privacy Policy and any order-specific terms we present at checkout, are the entire agreement between you and Yard Stop regarding the Services and supersede prior understandings on that subject.
• You may not assign these Terms without our consent; we may assign them in connection with a corporate transaction or otherwise as permitted by law.
